1 – OBJECT OF THE CONTRACT AND SCOPE OF APPLICATION
The “online” sales contract refers to a distance contract, i.e., a legal agreement concerning movable goods and/or services concluded between a supplier, Dream Bikes di Mauro Dipaola, and a consumer and/or customer within a distance selling system organized by the supplier, which, for this contract, exclusively uses the remote communication technology called “Internet.”
All contracts will therefore be concluded directly through the consumer and/or customer’s access to the website corresponding to the address www.dream-bikes.it, where, following the indicated procedures, they will conclude the contract for the purchase of the goods.

The general terms and conditions of sale are governed by Italian law and, in particular, by Legislative Decree 70/2003 concerning e-commerce and Legislative Decree 206/2005, specifically regarding distance contracts.
With particular reference to Title III "Contractual Modalities," Chapter II "Particular Modalities of Contract Conclusion," Section II "Distance Contracts"; Legislative Decree No. 70 of 9/4/2003, "Implementation of EC Directive No. 31/2000 on E-Commerce"; Legislative Decree No. 114 of 31/3/1998, "Reform of Commercial Regulations") govern all purchase contracts concerning the products sold on the website “www.dream-bikes.it” and concluded according to the modalities described here.
Dream Bikes di Mauro Dipaola does not issue invoices for orders received, as it avails itself of the tax discipline for mail-order sales, Art. 22, paragraph 1, No. 1 of Presidential Decree No. 633 of 1972 and Art. 2, letter oo, of Presidential Decree 696 of 21/12/1996.
These provisions allow the taxpayer to certify sales by annotating the daily total in the receipts register, with consequent exemption from the obligation to issue an invoice or fiscal receipt, as validated by the Revenue Agency for online sales.
However, it is possible to issue an invoice for customers who have a VAT number or who specifically request it at the time of the order by providing the correct personal tax code and/or VAT number. The invoice will be sent via email in PDF format and/or attached to the shipment.
No changes to the invoice will be possible after its issuance following the customer’s payment. In all other cases, a detailed delivery document will be attached to the shipment, which will also serve as proof for warranty purposes.
These General Terms and Conditions of Sale are deemed expressly accepted by anyone proceeding with an online purchase. The Customer declares that they have read all the information provided during the purchase process and fully and unconditionally accept these General Terms and Conditions of Sale. The submission of the purchase request implies full knowledge and unconditional acceptance of these General Terms and Conditions of Sale.
These General Terms and Conditions may be modified by Dream Bikes di Mauro Dipaola without any notice.
Each contract will be governed by the General Terms and Conditions of Sale in force at the time the Customer submits the order.
2 – CONCLUSION OF THE CONTRACT
To conclude a purchase order, the User must first register as a Customer on the website “www.dream-bikes.it,” providing information useful for delivery and the issuance of related fiscal documents. These data, which will be processed in accordance with the Privacy Law (L. 675/96), can be modified by the Customer at any time.
Registration does not oblige the user to make a purchase; the user who, after registering, intends to proceed with a purchase, must follow the procedure indicated by the IT system.
The purchase contract concluded between the Customer and Dream Bikes di Mauro Dipaola is deemed concluded with the acceptance, even partial, of the Customer’s order by Dream Bikes di Mauro Dipaola, which reserves the right, at its sole discretion, to accept the order.
This acceptance is deemed tacit unless otherwise communicated to the customer by any means. A confirmation email is sent to the email address provided by the Customer during registration.
This confirmation message will include the date and time of the order execution, a summary, and an identification number of the same to be used for any future communication with Dream Bikes di Mauro Dipaola. The customer is required to verify its accuracy and promptly communicate any corrections.
From that moment, the order is recorded in our system and will subsequently be processed and fulfilled by our Staff.
Dream Bikes di Mauro Dipaola mainly deals with exclusive and highly artisanal products that are produced in small quantities, making their availability objectively difficult. The actual availability of products in our warehouse is generally indicated on the site, and some products can be purchased even if not immediately available. There is also the possibility that, during the time between the registration of your order and its fulfillment, the product may no longer be available. In this case, our Staff will endeavor to order the product and then proceed with its shipment.
If the product is no longer available and Dream Bikes di Mauro Dipaola deems, at its sole discretion, that it cannot source the unavailable product on the market, the customer may opt for another product, to which the applicable prices and rates will apply, or cancel the order and receive a full refund of any amount already paid via bank transfer to the customer’s account.
In the event of non-acceptance of the order, Dream Bikes di Mauro Dipaola guarantees prompt communication to the Customer, in any case within 30 days of receipt of the order.
The Customer has no right to compensation or indemnity, nor any contractual or extra-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance, even partial, of an order.
If the customer is a consumer (i.e., a natural person purchasing goods for purposes unrelated to their professional activity), once the online purchase procedure is completed, they must print or save an electronic copy of their order and the related confirmation and, in any case, keep the current General Terms and Conditions of Sale in compliance with Articles 3, 4, and 45 of the Consumer Code (Legislative Decree 206/05) on distance sales outside commercial premises.
Dream Bikes di Mauro Dipaola reserves the right to change, without notice, the product catalog and related price lists.
All products offered for sale are described in detail (quality, characteristics, price) in the appropriate online catalog on the website “www.dream-bikes.it.”
The prices displayed on “www.dream-bikes.it” are inclusive of VAT (at the applicable rate and where applicable under Italian tax law) and refer exclusively to products sold online.
The price applied will be the one in force at the time of the order, without considering any price increases or decreases, including promotions, that may occur subsequently.
If a product is displayed with an incorrect price due to a typographical error or a pricing error by our suppliers, Dream Bikes di Mauro Dipaola reserves the right to refuse or cancel any order sent to us for items displayed with an incorrect price, without notice.
Dream Bikes di Mauro Dipaola reserves the right to refuse or cancel any such order, even in the case of confirmed orders for which payment has already been made. In the latter case, we will proceed to refund the payment. The refund will always be made via bank transfer to the customer’s account.
Shipping costs and any additional costs (packaging, transaction, and/or insurance costs) will be added to the price and will be displayed in total before the order is submitted.
The shipping cost varies based on the size, weight, and quantity of the packages to be shipped. It is the customer’s responsibility, is calculated automatically by the system, and is displayed before the conclusion of the order, also inclusive of VAT at the applicable rate where applicable.
Although Dream Bikes di Mauro Dipaola strives to provide the most complete and truthful product sheets and indications, please note that any images accompanying the product description sheet are for illustrative purposes only and may not coincide with the actual characteristics of the product, differing in color, size, or accessories shown in the image.

3 – PAYMENT METHODS
3.1 - Bank Transfer

The customer’s order will be held until proof of the bank transfer is received, which must be sent via email (info@dream-bikes.it) or fax (+390331554593) within 3 working days from the date of order acceptance.
The shipment will only occur upon actual crediting of the amount due to our bank account, which must occur within 7 working days from the date of order acceptance.
If these deadlines are exceeded, the order will be automatically canceled. No charges or penalties will be applied to the customer. The cancellation will be notified via email to the address provided by the customer during registration.
Banking practice provides that the transfer is credited to the beneficiary’s account within an average of 2/3 working days from its execution (often even earlier).
The shipment will depart on the working day following the actual receipt of the credit in our bank account.
Any order cancellation must be communicated via email to (info@dream-bikes.it) within 24 hours of its conclusion and in any case before the shipment is dispatched.
In case of orders canceled after shipment, €25 + VAT will be charged for shipping, storage, and return costs.
3.2 - Credit Card
We accept the most common credit cards belonging to the Visa, Visa Electron, Mastercard, American Express, and Carta Aura circuits, including prepaid and rechargeable cards. No surcharge will be applied for payments made by credit card.
The payment is managed by PayPal, a world leader in online transactions, which guarantees maximum security and protection for the buyer. PayPal uses an advanced automatic encryption system for confidential data exchanged directly between the buyer’s computer and PayPal servers without transiting the site “www.dream-bikes.it.”
PayPal also adheres to international PCI-DSS (Payment Card Industry Data Security Standards) compliance standards and uses sophisticated technology against cybercrime.
For Visa and Mastercard credit cards, it is necessary to enter the CVV2 code, i.e., the last 3 digits on the back of the card, otherwise, the order cannot be processed.
Orders made with a credit card, before being entrusted to the courier, are subject to authenticity checks directly with the relevant institutions. These checks may take a maximum of 24 hours (48 hours for American Express cards).
Dream Bikes di Mauro Dipaola reserves the right to request additional information from the Customer (e.g., a landline telephone number) or the submission of documents proving ownership of the card used.
In the absence of the requested documentation or if the transaction is deemed unsafe following authenticity checks, Dream Bikes di Mauro Dipaola reserves the right not to accept the order.
Dream Bikes di Mauro Dipaola uses the pre-authorization payment method, meaning it will decide at its discretion whether and when to accept the payment and, consequently, receive the credit. This method allows Dream Bikes di Mauro Dipaola to verify with the customer the actual intention to complete the order, especially when the purchased products are not available in stock and/or require long waiting times. Until the payment collection is authorized by Dream Bikes di Mauro Dipaola, the order will remain easily cancelable without additional costs for the Customer. Once Dream Bikes di Mauro Dipaola authorizes the payment, the amount will be effectively transferred, and the transaction fees applied by PayPal to Dream Bikes di Mauro Dipaola. Therefore, if the Customer decides to cancel an order and request a refund (directly or through PayPal) once the payment authorization has already been accepted and the money collected with the relevant PayPal fees applied, Dream Bikes di Mauro Dipaola reserves the right to retain from the refund the amount of the fees applied by PayPal on the transaction.
In case of order cancellation by Dream Bikes di Mauro Dipaola, the amount held will be released and fully refunded.
The release times, for some types of cards, depend exclusively on the banking system and can take up to their natural expiration (24th day from the authorization date).
Once the transaction cancellation has been made, in no case can Dream Bikes di Mauro Dipaola be held responsible for any direct or indirect damages caused by delays in the release of the held amount by the banking system.
For security reasons, payments will only be accepted from credit cards issued in the same country where the Orderer resides and where the delivery of the ordered goods is expected.
At no time during the purchase procedure is Dream Bikes di Mauro Dipaola able to know the information related to the buyer’s credit card, transmitted via a secure connection directly to the website of the banking institution managing the transaction. No computer archive of Dream Bikes di Mauro Dipaola will store such data.
In no case, therefore, can Dream Bikes di Mauro Dipaola be held responsible for any fraudulent and unauthorized use of credit cards by third parties at the time of payment for products purchased on “www.dream-bikes.it.”

3.3 - PayPal
It is possible to pay directly through the PayPal circuit, via your personal account.
The payment procedure is similar to that provided for credit cards, with the only exception that the funds will be withdrawn directly from your PayPal account (if present in sufficient quantity) and not from the credit card associated with it.
Once the payment is completed, you will receive a confirmation email also from PayPal. The payment system is secure and guarantees the confidentiality of the data processed through SSL (Secure Socket Layer) technology.
Any commissions or costs charged to the customer depend exclusively on the circuit manager, and no additional commission costs are applied by Dream Bikes di Mauro Dipaola on payments made via PayPal.

Dream Bikes di Mauro Dipaola will accept PayPal payments only to confirmed addresses and provided that the address registered on the PayPal account from which the payment is made corresponds to the actual shipping address.
Otherwise, the payment will not be accepted and consequently refunded.
Any order cancellation must be communicated via email to (info@dream-bikes.it) within 24 hours of its conclusion and in any case before the shipment is dispatched.
In case of orders canceled after shipment, €25 + VAT will be charged for shipping, storage, and return costs, in addition to the value of the commissions that PayPal retains on the transaction.
3.4 - Cash on Delivery
The possibility to pay for the purchased goods in cash on delivery directly to the courier upon delivery of the goods themselves is provided. This service is offered only for national shipments made within Italian territory and only through the express courier BRT. It is dedicated to Customers who are registered on the website www.dream-bikes.it through an account and who do not make the purchase as a guest but by accessing from their account.
Excluded from the possibility of cash on delivery payment are all those artisanal products that are considered made to measure or ordered to the customer’s specifications. The description of these products clearly includes the exclusion from the “cash on delivery” payment method, but the IT system does not allow preventing the customer from adding them to the cart and then selecting the “cash on delivery” payment method. In this case, Dream Bikes di Mauro Dipaola will proceed to cancel the order, promptly notifying the customer.
The courier will deliver the package only after receiving payment in cash. Checks or other forms of payment are not accepted.
The provisions on traceability and limits imposed by Article 12 of Legislative Decree 6 December 2011 n.201 set a maximum limit of €999.99 for cash payments. Dream Bikes di Mauro Dipaola, applying the law, accepts cash on delivery payments up to €999.99.
Although the system allows selecting the cash on delivery payment even for orders over €999.99, in reality, this procedure is not feasible, so the customer will be notified via email of the impossibility of making the payment for such an amount in cash on delivery.
This payment method provides for the application of a surcharge for each order, the amount of which is clearly indicated both before concluding the order and in the summary of the same.
This surcharge includes both the costs incurred for cash collection and the mandatory insurance to avoid unpleasant discrepancies regarding the refund of the goods in case of theft or damage during shipment.
If goods are returned due to non-collection by the customer who has made a regular order, Dream Bikes di Mauro Dipaola reserves the right to refuse future orders from the same customer with the cash on delivery payment method or even to refuse the execution of future orders and to request compensation for the costs incurred equal to €25 + VAT for delivery, storage, and return costs.
4 – SHIPPING
Shipping costs are the customer’s responsibility and are calculated based on the weight (the greater between volumetric weight and actual weight) and the destination of the order.
The total amount of the order, including shipping costs, will be visible before proceeding with the purchase confirmation and the conclusion of the contract, as provided for by Article 52 of the Consumer Code.
The time of entrustment to the courier varies depending on the chosen payment method and the availability of the products. If the chosen products are all available in stock:

PayPal and Postepay recharge provide for the shipment to be entrusted to the courier on the working day immediately following the payment.

For Cash on Delivery payment, the shipment will depart on the working day following the order confirmation.

For Bank Transfer payment, the shipment will depart on the working day following the actual crediting of the transfer to our Bank Account.

For Credit Card payment, the shipment will depart on the working day following the authenticity check to verify the ownership of the card, provided that it is successful.
Orders will only be fulfilled with completely available goods. If some ordered products are not available, Dream Bikes di Mauro Dipaola will inform the Customer of the supply times.
If the customer wishes to receive the available goods immediately and postpone the delivery of unavailable or pre-ordered items to a later time, they must opt for double shipment, indicating this intention in the order notes, with the obvious charge of double shipment.
To ensure fast and secure delivery, it is necessary to indicate the delivery address as accurately as possible, where the customer or their delegate is continuously present and reachable by phone for any contact by the courier or our assistance service.
It is therefore important to carefully verify the accuracy of the shipping and contact data entered during the order and to provide the complete address with useful information for delivery, such as staircase, internal number, intercom, etc., and a telephone number.
The order will not be fulfilled if the mandatory fields are not correctly filled in.
Dream Bikes di Mauro Dipaola is not responsible for any delays and/or failed deliveries caused by incomplete or inadequately provided addresses during the order.
By filling in the personal data form in the registration procedure necessary to activate the process for the execution of this contract and the related further communications, the consumer and/or customer authorizes Dream Bikes di Mauro Dipaola to communicate non-sensitive personal data (residence, telephone number) to the trusted couriers and/or shippers used for the delivery of the purchased goods to allow the necessary procedures for their delivery.
No shipments are made to poste restante or to post office boxes, fairs, port warehouses, prisons, hospitals, and military bases.
No deliveries are made to the floor; the goods will be delivered at street level.
The couriers used normally do not make advance phone calls nor manage requests for shipments at particular or scheduled times.
4.1 - National Shipments (Italy)
Shipments made within Italian territory are carried out exclusively using the carriers BRT, GLS, and DHL. The average delivery times are 24h for regional capitals, 24-48h for the province, and 72h for shipments destined for Calabria, Sicily, and Sardinia.
Different delivery times may be provided for some disadvantaged or peripheral locations for which additional costs may be required.
All deliveries are made on working days, therefore from Monday to Friday inclusive, excluding holidays. These times are therefore counted accordingly from the moment Dream Bikes di Mauro Dipaola entrusts the shipment to the carrier and are to be considered indicative and subject to various variables/unforeseen events such as staff strikes, adverse weather conditions, periods of high workload (Christmas holidays, etc.).
Dream Bikes di Mauro Dipaola, therefore, cannot be held responsible for any delay compared to the average times indicated.
Once the package is shipped, Dream Bikes di Mauro Dipaola will provide the customer with the tracking code via a dedicated email (sent to the registration address on dream-bikes.it), which will allow monitoring the shipment online on the BRT (https://services.brt.it/it/tracking), GLS (https://www.gls-italy.com/it/servizi-per-destinatari/ricerca-spedizione/), or DHL (https://www.dhl.com/it-it/home/tracciabilita.html) courier’s website.
The tracking service is usually available from the working day following the shipment.
The tracking code will also allow the customer to interact directly with the carrier in case of any problems related to the delivery.
The tracking code is also available within the personal area on the website www.dream-bikes.it with reference to the order in question.
In case of failed delivery due to the customer’s absence, the procedure for failed delivery will be followed: the courier, after the first unsuccessful attempt, will try again in the next two working days.
In case of further unavailability, the order will be redirected to the nearest carrier branch (BRT, GLS, or DHL), and it will be the customer’s responsibility to monitor the shipment and promptly contact the competent branch to arrange the pickup/delivery of the package before it is put in storage.
From the moment the carrier (BRT, GLS, or DHL) opens the storage file, Dream Bikes di Mauro Dipaola will proceed to release the shipment, the order will be canceled, and the ordered goods will return to our warehouse. Dream Bikes di Mauro Dipaola will refund the order, retaining from the total collected an amount equal to double the shipping costs incurred (thus also counting the cost of the shipment for the return of the goods to our headquarters) and €10.00 as a penalty and reimbursement for the storage costs incurred. The refund of the residual amount will be made exclusively by Bank Transfer, so the customer must communicate their Bank Details (IBAN and Account Holder) to us. It will also be Dream Bikes di Mauro Dipaola’s right to exclude the customer from any future reorders.
DHL, through the "On Demand Delivery" service, offers the Customer greater flexibility in arranging delivery with the possibility of changing the address or delivery day (https://delivery.dhl.com/prg/on-demand-delivery.xhtml?ctrycode=IT).
Dream Bikes di Mauro Dipaola adopts a high-quality and secure packaging service using the best materials with adhesive tapes and security labels customized with its logo to make any tampering attempt with the package evident. The packaging we use is specifically designed to provide maximum reliability and security during the delicate transport phase.
Since the packaging is 100% recyclable, we invite you to dispose of it in the separate waste collection, so that it can be reused to produce new packaging and have a lower environmental impact.
Upon receipt of the package, the Customer is invited to check that the package is intact and not damaged: any complaints must be reported to the courier by indicating on the consignment note that you sign for collection, the wording "Collected with reservation of control" and the reason for the reservation.
This allows you to protect yourself if any anomalies are found after opening the package. Only in the latter case should the incident be reported by fax to the local courier office and for information to Dream Bikes di Mauro Dipaola at the email address: info@dream-bikes.it.
In particularly serious cases, Dream Bikes di Mauro Dipaola may request the complete return of the received product to be able to claim against the shipper. Otherwise, the package is considered correctly delivered, and once the courier’s document is signed, the Customer cannot raise any complaints about the external characteristics of what was delivered.
The consumer and/or customer from the moment they receive the damaged goods or request their redelivery to the carrier has direct and exclusive action against the carrier itself.
The latter is also responsible for the delay in the delivery of the goods to the recipient. Dream Bikes di Mauro Dipaola, in such cases, must be considered exempt from any responsibility for loss or damage (damage) to the goods from the moment they are delivered without reservation to the carrier for transport.
In case of partial loss or damage not recognizable at the time of delivery, the consumer and/or customer must report the damage to the carrier, under penalty of forfeiture, as soon as it is known and no later than seven calendar days from receipt by registered letter with return receipt (art. 1698 Consumer Code).
By law, the goods always travel at the risk and peril of the recipient, after the goods are entrusted to the courier, Dream Bikes di Mauro Dipaola cannot be held responsible for any loss, damage, incorrect or failed delivery caused by events or causes of force majeure or fortuitous event.
In case of damage suffered during transport, the carrier issues a refund based on the weight of the package, which in the case of the products we deal with has almost a symbolic value. The international air shipment service via DHL Express Courier is called “Worldwide Express” and is a very fast premium service that covers over 200 countries worldwide. Therefore, if the DHL Express Courier Worldwide Express shipment option is not selectable, it means that the destination country is not included among those covered by this service or among those where we do not ship.
It is an express service with average delivery times of about 1-2 working days for shipments within the European Community and about 1-5 working days for shipments outside the European Community. These times, in addition to being indicative, are always counted from the working day following the shipment and do not count any additional times for customs procedures required for countries outside the European Community.
The international land shipment service via DHL Express Courier is called "Economy Select" and is a truck service that covers the European territory, offering lower delivery costs in exchange for lower speed, with indicative times of 2-4 working days depending on the destinations.

Orders of lower value will not be accepted or allowed by the system.

5 – ORDER CANCELLATION
5.1 - By the Customer:
Once an order is completed on www.dream-bikes.it, a confirmation email with all the order details is always sent. If you realize you have made a mistake or have a change of mind, there is the possibility to cancel an order, provided that you send an email to (info@dream-bikes.it) within 24 hours of its conclusion and in any case before the shipment is dispatched. In the email, write “cancellation of order number…” and possibly the reason for the cancellation.
Dream Bikes di Mauro Dipaola, with the intent of providing an efficient and high-level service, makes quick shipments with very short order processing times, so it is of fundamental importance that the order cancellation occurs within 24 hours of its receipt and possibly even earlier to avoid that it has already been processed and entrusted to the carrier for shipment. 7 – PRODUCT REPLACEMENT
In the event that, due to a mere error, a product different from the one ordered by the consumer-customer is delivered, as specified in the purchase request (e.g., different model or color), Dream Bikes di Mauro Dipaola undertakes, as soon as possible, to proceed with the replacement of the product itself.
To this end, it is necessary that the customer promptly informs Dream Bikes di Mauro Dipaola of the discrepancy found, sending a communication to the email address info@dream-bikes.it. Only and exclusively in this hypothesis, the shipping costs that the customer will have to bear to return the product and those that Dream Bikes di Mauro Dipaola will have to bear to make the redelivery of the product will be entirely borne by Dream Bikes di Mauro Dipaola.
8 – RIGHT OF WITHDRAWAL
Dream Bikes di Mauro Dipaola adheres to the Consumer Code issued by Legislative Decree 6 September 2005, n. 206, based on Article 7 of the delegation law 29 July, n. 229, relating to the reorganization of the existing provisions on consumer protection, which includes most of the provisions issued by the European Union for consumer protection. Definitions:

Dream Bikes will have the right to withdraw from the contract entirely or partially by written communication to be sent to the Buyer by email. The Buyer will not have the right to receive any compensation for damages possibly resulting from the withdrawal of Dream Bikes di Mauro Dipaola.
The consumer-buyer has the right to withdraw from the contract with Dream Bikes di Mauro Dipaola, without any penalty and without specifying the reason, within the term of 10 working days from receipt of the goods.
The Professional Buyer cannot exercise the right of withdrawal.
The parties agree that the indication in the order of a VAT number in the order form, or in the registration of personal information, of a VAT number or in any case the issuance of an invoice to a VAT number relating to the order in question, qualifies the buyer as a professional. The right of withdrawal, therefore, CANNOT be exercised by legal and natural persons acting for purposes related to a commercial activity.
The right of withdrawal is also excluded for purchases made by resellers or by subjects who for any reason purchase for resale to third parties.
The right of withdrawal does not apply also for the supply of goods ordered on request, made to measure or to the customer’s specifications or in any case clearly personalized. Within the description sheet of these products (on the dream-bikes.it site) there is generally always a specific note that makes them identifiable in this sense.

The registered letter is deemed sent in time if delivered to the accepting post office within 10 working days from the delivery of the goods.
Following written communication from the Buyer (registered letter with return receipt), Dream Bikes di Mauro Dipaola will send confirmation of the withdrawal via email to the address indicated in the order and will communicate, with the same means, the Withdrawal Authorization Number (NAR), which must then be clearly reported on the packages subject to withdrawal.
Execution of the right of withdrawal by the Buyer:
The right of withdrawal will be deemed exercised regularly and correctly by the Buyer only and exclusively if carried out in compliance with the aforementioned terms, modalities, and necessary conditions.
With the receipt of the withdrawal communication, the contracting parties are released from their respective obligations arising from the distance sales contract. If not all the provisions established in these general conditions of sale are respected regarding the correct and regular exercise of the right of withdrawal, the consumer-buyer does not have the right to obtain a refund of the sums paid as consideration for the purchase of the product.
The consumer-buyer is, however, recognized the right to obtain, at their own expense, the return of the same product originally delivered and subsequently returned by the consumer-buyer.
In the event that the consumer-buyer does not intend to avail themselves of the aforementioned right, the exercise of which must be promptly communicated by sending an email to the email address info@dream-bikes.it, the supplier party is deemed authorized to retain the returned product and the sums already paid as consideration for the purchase of the product itself.
9 – WARRANTIES AND RETURNS
All products sold by Dream Bikes di Mauro Dipaola are covered by the manufacturer’s conventional warranty and by the 24-month warranty for conformity defects, pursuant to Articles 128 et seq. of Legislative Decree No. 206/2005 (Consumer Code).
Dream Bikes also markets highly artisanal products of high quality, but which as such may present slight aesthetic imperfections that do not compromise their correct functioning; these imperfections should not therefore be considered as defects but as particular characteristics due to the purely manual creation of the products themselves.
To benefit from the warranty assistance, the Customer must keep the purchase document that they will receive attached to the shipment (of which they can also save a copy within their account on dream-bikes.it) and contact us preferably via email at info@dream-bikes.it.
The exercise of the Warranty may involve the request for assistance also directly at the manufacturer of the defective good; it will be our care to illustrate the correct procedure for the application of the warranty in the specific case.
The 24-month warranty pursuant to DL 24/02 applies to the product that presents conformity defects and/or malfunctions not detectable at the time of purchase, provided that the product itself is used correctly, in compliance with its intended use and with what is provided in the eventual technical documentation attached, with observance of the various operating standards indicated therein.
The aforementioned warranty will not apply in case of incorrect installation, negligence, and carelessness in the use and maintenance of the product.
The warranty is personal and therefore will apply only to the original buyer being reserved to the private Consumer (natural person who purchases the goods for purposes not related to their professional activity, i.e., makes the purchase without requesting an invoice with VAT number).
It is the Customer’s responsibility to prove that it is a conformity defect existing at the time of the conclusion of the contract, unless it manifests itself within six months from delivery (art. 1519 sexies c.c.).
The complaint of the defect must be made within two months from discovery, under penalty of forfeiture (art. 1519 sexies c.c.)
The defective goods can only be returned after Dream Bikes has authorized this operation by issuing an RMA code for authorization to return.
The practice will only be taken into consideration if the returned package contains the sales document or purchase invoice, and the RMA number for authorization to return defective goods (this number must be clearly visible on the outside of the package).
The costs of returning the goods to the sender, incurred by the Customer, remain at the expense of the same as well as the risks of transport of the goods. The Customer can freely choose whether to insure the shipment without any obligation of reimbursement by the Seller.
Shipments sent in “port assigned” will not be accepted unless previously agreed with the Seller.
Dream Bikes di Mauro Dipaola reserves the right to verify the actual defect highlighted by the customer and to proceed with the replacement of the defective product only after such control.
The good recognized as defective (at the sole discretion of Dream Bikes di Mauro Dipaola or the manufacturer of the good itself) will be repaired or replaced depending on the nature of the defect with a timing generally defined by the assistance center of the manufacturer of the good.
For this reason, Dream Bikes di Mauro Dipaola cannot be held responsible for any delays in the repair or replacement of the defective good.
If, on the other hand, repair or replacement of the good is not possible or excessively burdensome, the Customer may request, at their choice, an appropriate reduction in the price or the termination of the contract where one of the following conditions occurs:
a) The repair or replacement is impossible or excessively burdensome
b) The seller has not proceeded with the repair or replacement of the good within the appropriate term
c) The replacement or repair previously carried out has caused considerable inconvenience to the consumer
In determining the amount of the reduction or the sum to be refunded, the use of the good is taken into account (art. 1519 quater c.c.)
If, on the other hand, the good is recognized as intact and perfectly functioning, i.e., without the conformity defect complained of, differently from what was declared by the Customer, Dream Bikes di Mauro Dipaola reserves the right to charge the Customer for any costs incurred for the verification of the product and for its reshipment.
10 – COMPLAINTS
Any complaint must be sent via email to info@dream-bikes.it. The Customer will receive an email confirming the opening of the complaint within the next five working days; with the same communication, instructions for the definition of the procedure and requests for clarifications or documentation will be forwarded. In compliance with the current legislation, the Customer/Consumer, in case of a complaint filed after six months from the delivery of the product, must provide suitable documentation proving that the conformity defect existed at the time of delivery.
For complaints filed within six months of delivery, Dream Bikes di Mauro Dipaola reserves the right to verify the existence of the defect complained of by the Customer/Consumer, to be carried out at the relevant assistance center used by the seller, before granting the requested remedy or the alternative one provided by law.
11 – LIMITATION OF LIABILITY
